Yes, he used a pirated game to test his hack. But that doesn't mean he was hacking it solely to play said games. He was using his hacked one for pirated games. Sure, pretty straightforward logic there. BUT, doing it for other people....not so striaght-forward. Many people just want it modded to play homebrew and indie games. Not pirated ones. If you don't specifically ask him to do it so they can play pirate games...then there's no case there. And even if you did ask him that specifically, does that fact that what he's doing CAN be used only for homebrew, etc. mean that he's guilty? I guess I don't know.
